Terms & Conditions

1. INTERPRETATION

1.1 In these Conditions:

Buyer – Customer” means the person who accepts a quotation of the Seller for the sale of Goods or whose order for the Goods is accepted by the Seller.

Goods” – means the goods which the Seller is to supply in accordance with these Conditions.

Seller” includes Fiximer Solid Oak, currently trading from Unit 36, Churchill Road, Doncaster, DN1 2TF, registered in England under VAT registration number GB196225292.

Conditions” means the standard terms and conditions of sale set out in this document and includes any special terms and conditions agreed in writing between the Buyer and the Seller.

1.2 The headings in these Conditions are for convenience only and shall not affect their interpretation.

2. BASIS OF THE SALE

2.1 Our free design service is without obligation and based on information that Buyer provide.
2.2 The drawings supplied show an example of the overall layout and do not represent an exact finish. If the Buyer is happy to proceed with an order then a full site survey will be carried out where colours, any extras and finished designs can be discussed and planned ready for work to commence.
2.3 Any 3D plans provided by our designers are a computer representation only and may not represent exactly the manufactured project.
2.4 Handles are included from our standard range unless Buyer specify otherwise. Prices will be amended accordingly with the alternative handles for the order.

3. ORDERS AND SPECIFICATIONS

3.1 The Buyer shall be responsible to the Seller for ensuring the accuracy of the terms of any order (including any applicable specifications) submitted by the Buyer, and within a sufficient time to enable the Seller to perform the Contract in accordance with its terms.
3.2 The quantity, quality and description of and any specification for the Goods shall be those set out in the Seller’s quotation (if accepted by the Buyer) or the Buyer’s order (if accepted by the Seller).

4. THE PRICE OF GOODS

4.1 The price of the Goods shall be the Seller’s quoted price or, where no price has been quoted. All prices quoted are valid for 3 months only until earlier acceptance by the Buyer, after which time they may be alerted by the Seller and notifying the Buyer.
4.2 A deposit of 50% of the quoted price is required before we will order materials for your project. Balance is paid at the completion.
4.3 Our quote is subject to VAT at 20%.

5. TERMS OF PAYMENTS

5.1 Subject to any special terms agreed in writing between the Buyer and the Seller, the Seller shall be entitled to invoice the Buyer for the price of the Goods on or at any time after delivery of the Goods, unless the Goods are to be collected by the Buyer or the Buyer wrongly fails to take delivery of the Goods, in which event the Seller shall be entitled to invoice the Buyer for the price at any time after the Seller has notified the Buyer that the Goods are ready for collection.
5.2 The Buyer shall pay the price of the Goods within 7 working days of the date of the Seller’s invoice, and the Seller shall be entitled to recover the price; the receipt for payment will be issued only upon request.
5.3 Our furniture is made to order and cannot be cancelled once the deposit has been made, and Terms and Conditions signed and returned to us. We will not issue refunds on cancelled order.
5.4 All materials, furniture, extras remain the property of Fiximer Kitchens & Bedrooms and we will retain the right to return them to our workshop if final payment is not made after installation.

6. INSTALLATION

6.1 We estimate 6-8 weeks from instruction to installation but this may vary. We will advise you of an estimated date for installation and confirm with you as the project progresses.

7. WARRANTY

8. LIMITATION OF LIABILITY

8.1 Whilst we will do our best to deliver and install within the timescales indicated to you, we shall not be liable for any loss or delay.
8.2 In the case of supply only, it is the customer’s responsibility to ensure the installer used is competent and adequately qualified. Fiximer Solid Oak can accept no liability for faulty goods as a result of poor fitting.
8.3 If you are a business user, please note that, in particular, Fiximer Solid Oak will not be liable for: loss of profits, sales, business, or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.

9. FITTING

9.1 The customer warrants that the premises are structurally suitable for the installation. Unless otherwise stated our quotation for fitting assumes that the room or kitchen is cleared so far as is possible and any items to be retained are removed by the customer.

10. DATA AND PRIVACY

10.1 All sensitive data such as customer names, credit card numbers, bank accounts and purchase history, will not be passed on to other companies/third-party. All details will be stored securely and confidential.
